What is Bankruptcy?

Bankruptcy is the legal process by which a person or business who owes more money to creditors than they can afford to repay may work out a plan to repay the amount over a period of time, or for most of those debts to be discharged completely.

During a pending bankruptcy case, the Bankruptcy Code provides that all creditors must stop any and all collection efforts against debtors. This provision is called the “automatic stay” and some creditors can be relieved from this under certain circumstances but they must be granted permission by the court in order to do so.
The District of Maine is broken into two court locations: Portland and Bangor. Your court location is dependent upon the county you reside in.
